    Το συμπέρασμα πρέπει να παραμένει περιορισμένο. Η φράση “δεν βρέθηκαν ανοικτά κενά στο δηλωμένο πεδίο και στα έγγραφα που εξετάστηκαν” μπορεί να στηριχθεί όταν είναι αληθής. Η φράση “εγκρίθηκε το CE” δεν μπορεί. Η σήμανση CE είναι δήλωση του κατασκευαστή μετά την κατάλληλη αξιολόγηση και όχι γενική έγκριση που πωλεί ένας ελεγκτής. Το αρχικό νομικό κείμενο και η ισχύουσα ενοποιημένη έκδοση παραμένουν τα σημεία αναφοράς για τον τελικό νομικό έλεγχο.

    Ένας έλεγχος προμήθειας έχει όρια. Μπορεί να μην αποδεικνύει αν κρυφός πηγαίος κώδικας εφαρμόζει τη δηλωμένη λογική ασφάλειας, αν ένα δείγμα αντιπροσωπεύει τη σειρά παραγωγής ή αν μια αλλαγή διασύνδεσης είναι ουσιώδης. Δηλώστε τα μη διαθέσιμα στοιχεία, τα όρια δειγματοληψίας, τις μεταφράσεις που χρησιμοποιήθηκαν, τα όρια πρόσβασης στο λογισμικό και τις ανοικτές νομικές ερμηνείες. Όταν είναι αβέβαιη η διαδρομή, η ταξινόμηση στο παράρτημα I ή το πεδίο δοκιμών, ζητήστε γνώμη από κατάλληλο ειδικό ασφάλειας μηχανημάτων, νομικό σύμβουλο ή αρμόδιο κοινοποιημένο οργανισμό.

    Η ανάλυση αυτή δεν αποτελεί νομική συμβουλή και δεν πιστοποιεί ρομπότ. Σκοπός της είναι να μην μπερδέψει το ξενοδοχείο έναν τακτοποιημένο φάκελο με αποδεδειγμένη συμμόρφωση. Η επόμενη απόφαση είναι πρακτική: παγώστε την πληρωμή ή τη λειτουργία στη σωστή πύλη μέχρι ο υπεύθυνος να παραδώσει στοιχεία που πληρούν τον καταγεγραμμένο όρο αποδοχής.

    Συχνές ερωτήσεις

    Αποδεικνύει ένας πλήρης πίνακας ότι το ρομπότ συμμορφώνεται με CE;

    Όχι. Καταγράφει το πεδίο και το αποτέλεσμα ενός ελέγχου εγγράφων. Ο κατασκευαστής παραμένει υπεύθυνος για την αξιολόγηση, την τεχνική τεκμηρίωση, τη δήλωση συμμόρφωσης ΕΕ και τη σήμανση CE. Ο ελεγκτής δεν πρέπει να παρουσιάζει τον πίνακα ως πιστοποιητικό.

    Μπορούμε να δεχθούμε έκθεση δοκιμής παρόμοιου μοντέλου;

    Μόνο αν ο κατασκευαστής δείξει γιατί η δοκιμασμένη διαμόρφωση αντιπροσωπεύει το προϊόν που αγοράζεται και ποιους ισχυρισμούς στηρίζει. Διαφορές σε φορτίο, αισθητήρες, φρένα, λογισμικό ελέγχου, μπαταρία ή περιβάλλον μπορεί να κάνουν την έκθεση ανεπαρκή.

    Πρέπει το ξενοδοχείο να λάβει ολόκληρο τον τεχνικό φάκελο;

    Ο Κανονισμός απαιτεί από τον κατασκευαστή να διαθέτει την τεκμηρίωση στις αρχές και από τον εισαγωγέα να εξασφαλίζει τη διαθεσιμότητά της. Το ξενοδοχείο μπορεί να μην έχει αυτόματο δικαίωμα σε κάθε εμπιστευτική λεπτομέρεια. Πρέπει να συμφωνήσει συμβατικά τα στοιχεία, την πρόσβαση και τις υποχρεώσεις απόκρισης που χρειάζεται για ασφαλή εγκατάσταση.

    Πώς κοστολογείται μια ανεπαρκής εκτίμηση κινδύνου;

    Μην βάζετε ενιαία τιμή στην ένδειξη. Ορίστε τους κινδύνους, τις διασυνδέσεις, τις απαιτήσεις, τα μέτρα και την επαλήθευση που λείπουν. Μετά ζητήστε προσφορές για τη μηχανική εργασία, τις δοκιμές, την τεκμηρίωση και τον έλεγχο που απαιτεί ο όρος αποδοχής.

    Τι γίνεται όταν αλλάζει το λογισμικό μετά τον έλεγχο;

    Εξετάστε την αλλαγή σε σχέση με την εκτίμηση κινδύνου, τις λειτουργίες ασφάλειας, την προβλεπόμενη χρήση και τη βασική διαμόρφωση. Ενημερώστε τα επηρεαζόμενα στοιχεία και επαναλάβετε την επαλήθευση όπου χρειάζεται. Ένας φάκελος που αντιστοιχούσε στην έκδοση Α δεν καλύπτει αυτόματα την έκδοση Β.

  • Technical file gaps: evidence and closing costs

    Technical file gaps should be reviewed against a narrow procurement question: is the evidence complete enough to support the manufacturer’s conformity decision for the exact robot being bought? The review is not a CE certificate, and a coloured spreadsheet cannot turn missing engineering evidence into compliance. Its useful output is a controlled list of what is present, what is missing, what is inadequate, who must close each gap, and which commercial commitment depends on closure.

    The timing matters. The European Commission says Regulation (EU) 2023/1230 applies on a mandatory basis from 20 January 2027. Machinery placed on the EU market before that date must comply with Directive 2006/42/EC. A hotel reviewing a file in 2026 therefore needs the expected placing-on-the-market date and the applicable legal regime. It should not mark a 2006/42 file against the new Annex IV without explaining that the exercise is a readiness review rather than the mandatory assessment route for that placement.

    Start with the product and the legal route

    Do not open with a document count. Start with the machine identity: model, variant, serial or batch range, software and safety-control versions, intended use, reasonably foreseeable misuse, accessories, charging equipment, lift or door interfaces, and the economic operators named on the product and declarations. A test report for a similar model may be useful background, but it is not automatically evidence for the purchased configuration.

    The 27 July 2026 consolidated text of Regulation (EU) 2023/1230 requires the manufacturer to draw up the technical documentation in Annex IV Part A. The manufacturer must also carry out the applicable Article 25 conformity assessment before placing the product on the market or putting it into service. Part B covers partly completed machinery. The distinction changes the documents and the party that must complete the final machinery assessment.

    Record the conformity route beside the product identity. Check whether the product falls within Annex I, whether a harmonised standard route is claimed, and whether a notified body is required or has been used. The common EU conformity-assessment framework explains why technical documentation and supporting evidence sit inside the chosen module. The file review cannot be separated from that route.

    Build an Annex IV evidence map

    Annex IV Part A is the review index for machinery and related products. Map each requirement to an exact file name, revision, date, author or issuing laboratory, and applicable product version. Start with the general description, drawings, control-circuit descriptions, risk assessment, applicable health and safety requirements, protective measures and residual risks. Then map the standards or other technical specifications, calculations, examinations, test results, instructions, incorporated-product documents and the EU declaration of conformity.

    The official European Commission CE-marking overview places technical documentation inside the manufacturer’s conformity work. In practice, the file must show design, manufacture and operation, identify applicable rules and standards, record risk analysis, and explain how risks were addressed. A folder full of certificates without the chain from hazard to requirement, design measure and verification result is not a usable technical case.

    For machinery placed before 20 January 2027, use Directive 2006/42/EC and its Annex VII as the mandatory baseline. Keep a separate readiness column for the 2023/1230 changes. This avoids two errors: claiming that the new Regulation already governs every 2026 placement, or waiting until 2027 to identify evidence that will be expensive to reconstruct.

    Use three marks, then add an ownership field

    Mark Meaning Acceptable record Next action
    Present The required evidence exists, matches the exact product and is internally consistent. File name, revision, date, product version and reviewer note. Preserve the controlled copy and check whether later changes affect it.
    Missing No evidence was supplied for an applicable requirement. The request made, supplier response and due date. Assign the manufacturer or other responsible party to create or obtain it.
    Inadequate A document exists but cannot support the claimed conclusion. The defect, affected requirement and consequence. Revise, repeat, extend or replace the evidence.

    Do not use “present” to mean that a filename exists. A risk assessment that omits collision during map loss is inadequate if that hazard is reasonably foreseeable. A test report with no model linkage is inadequate. An unsigned declaration is inadequate. A manual for another software branch is inadequate. The defect note should be factual and specific enough for an engineer or laboratory to act on it.

    Add two fields that the traffic-light view usually misses: owner and acceptance condition. The owner may be the manufacturer, importer, integrator, test laboratory, translation provider or hotel. The acceptance condition states what closes the gap, such as a revised risk assessment approved under document control or a test report that identifies the exact hardware and software configuration. Without those fields, the register records concern but does not manage work.

    Separate the duties in the supply chain

    The manufacturer owns the technical documentation and the conformity assessment. The Commission’s CE guidance for manufacturers lists the core sequence: identify applicable rules and standards, verify requirements, carry out the assessment, set up technical documentation, issue the declaration and affix the marking. A consultant may review or help prepare evidence, but the consultant does not replace the manufacturer or assume the declaration merely by annotating the file.

    Under Article 13 of the current Regulation, an importer must check that the manufacturer completed the appropriate assessment and drew up Annex IV Part A documentation. The importer keeps a copy of the EU declaration of conformity for at least ten years and must ensure that the technical documentation can be made available to authorities on request. A distributor performs document and marking checks under Article 15. The hotel’s purchase team should identify which role its supplier actually occupies instead of accepting the word “dealer” as a legal classification.

    The hotel is normally the user and employer, not the manufacturer. That can change if it manufactures machinery for its own use or makes a substantial modification under Article 18. Integration decisions involving payload, speed, sensors, maps, APIs, automatic doors or lifts must be screened before they are treated as harmless configuration. Ergasa’s earlier analysis on who is the service robot manufacturer explains the role classification, while the notified-body decision guide covers the Annex I route.

    Test quality, not paper volume

    A good review follows claims across documents. The intended use in the manual should match the risk assessment. The model on the declaration should match the label and test reports. Protective measures in the risk assessment should appear in drawings, control logic, verification records and user instructions. Residual risks should reach the operator. Software that affects a safety function should have a controlled identity and change history.

    Standards need the same treatment. Under Regulation (EU) No 1025/2012, a harmonised standard is adopted following a Commission request, and its reference is published for the relevant legislation. The current implementing decision listing machinery standards for Directive 2006/42/EC is the place to verify published references for the present regime. A supplier’s bare statement that it used “ISO standards” does not establish which requirements receive a presumption of conformity.

    The 2022 Blue Guide is useful for checking the horizontal logic of technical documentation, traceability and economic-operator roles. It is guidance, not a substitute for the sector legislation. Record which source controls each conclusion so that a future reviewer can distinguish law, Commission guidance, a harmonised standard and the team’s own interpretation.

    Turn technical file gaps into scoped work and cost drivers

    Closing cost is not the number of red cells multiplied by a standard fee. One missing declaration may take little time after the evidence is complete. One inadequate risk assessment may require design changes, software work and repeat testing. Price each gap as a work package only after the acceptance condition and responsible party are clear.

    Rank technical file gaps by the decision they block, not by how untidy the document looks. A gap tied to an unresolved safety function or conformity route carries a different procurement consequence from a formatting defect.

    Work package Typical trigger Cost driver to quote
    Document reconstruction Drawings, bills of materials or design calculations are absent or uncontrolled. Engineering hours, product variants and access to original design data.
    Risk-assessment repair Hazards, applicable requirements or risk-reduction measures are incomplete. System boundaries, operating modes, interfaces and specialist disciplines.
    Verification or testing A safety claim has no traceable result or the tested configuration differs. Laboratory scope, samples, fixtures, travel, repeat tests and report revision.
    Software evidence Safety-related versions, logic, validation or update control are unclear. Code access, architecture review, configuration baseline and regression tests.
    Conformity-body work The chosen Article 25 route requires independent assessment. Scope, review rounds, testing, audit time and corrective actions.
    Instructions and translation Required information is missing, inconsistent or unavailable for the Greek user. Source quality, technical writing, languages, review and controlled reissue.

    Use a transparent estimate: total gap-close cost equals internal hours at the hotel’s or importer’s loaded rate, plus supplier engineering, external testing, conformity-body fees where applicable, translation, travel, samples, retesting, and operational delay. Keep every input as a quote or named assumption. Do not manufacture a return-on-investment percentage from an unfinished file.

    The market-surveillance framework in Regulation (EU) 2019/1020 gives authorities powers to request documents, technical specifications and compliance information, including access to embedded software where necessary. That enforcement exposure is one reason to cost document access and retrieval time rather than assume the supplier will answer later.

    Use procurement gates instead of a certificate claim

    The mark-up should control commercial decisions. A hotel can tie deposit release, shipment, final payment, site acceptance and go-live to different evidence states. A missing manual translation may block go-live but not factory testing. A missing conformity route or an unresolved safety-control test should block acceptance much earlier. The contract must say which party pays for closure and what happens if the evidence never arrives.

    Keep the review conclusion narrow: “no unresolved gaps were found against the stated scope and documents reviewed” is defensible when true. “CE approved” is not. CE marking is the manufacturer’s declaration after the applicable assessment, not a general approval sold by a reviewer. The original legal act and its consolidated version should remain the reference points for the final legal check.

    A procurement review has limits. It may not establish whether hidden source code implements the claimed safety logic, whether a sample represents series production, or whether an interface change is substantial. State unavailable evidence, sampling limits, translations relied upon, software access limits and unresolved legal interpretation. Where the route, Annex I classification or test scope is uncertain, obtain advice from a qualified machinery-safety professional, competent legal adviser or appropriately notified body.

    This analysis is not legal advice and does not certify a robot. Its purpose is to stop a hotel from confusing a neat document pack with a demonstrated conformity case. The next decision is practical: freeze payment or deployment at the relevant gate until the named owner supplies evidence that meets the recorded acceptance condition.

    Frequently asked questions

    Does a complete mark-up prove that the robot is CE compliant?

    No. It records the scope and result of a document review. The manufacturer remains responsible for the applicable conformity assessment, technical documentation, EU declaration and CE marking. A reviewer should not describe the spreadsheet as a certificate.

    Can we accept a test report for a similar robot model?

    Only after the manufacturer shows why the tested configuration represents the purchased product and which claims the report supports. Differences in payload, sensors, brakes, control software, battery or operating environment may make the report inadequate.

    Must the hotel receive the manufacturer’s entire technical file?

    The Regulation requires the manufacturer to keep the documentation available to authorities, while the importer must ensure it can be made available. A hotel may not have an automatic right to every confidential design detail. It should contract for enough evidence, access and response obligations to complete due diligence and support safe deployment.

    How should we price an inadequate risk assessment?

    Do not assign a flat price to the label. Define the missing hazards, interfaces, requirements, protective measures and verification work. Then obtain quotes for the engineering, testing, documentation and review needed to meet the acceptance condition.

    What happens when software changes after the review?

    Screen the change against the risk assessment, safety functions, intended use and configuration baseline. Update affected evidence and repeat verification where necessary. A file that matched version A does not automatically support version B.

    Καταγράψτε μία σαφή απόφαση

    Πριν την τελική πληρωμή καταγράψτε την κατηγορία του παραρτήματος I και τη διαδικασία αξιολόγησης. Το μέρος Α χρειάζεται επαληθευμένη διαδικασία κοινοποιημένου οργανισμού. Το μέρος Β χρειάζεται πλήρη κάλυψη προτύπων για την ενότητα Α ή επαληθευμένη διαδικασία τρίτου. Ένα μη καταχωρισμένο μηχάνημα χρειάζεται ενότητα Α και πλήρη αξιολόγηση του κατασκευαστή. Αν ο προμηθευτής δεν μπορεί να προσδιορίσει τις λειτουργίες ασφάλειας, τη μαθησιακή συμπεριφορά και τη διαδικασία του άρθρου 25, ο φάκελος δεν είναι έτοιμος για αποδοχή.

    Η Ευρωπαϊκή Επιτροπή αναφέρει ότι ο Κανονισμός εφαρμόζεται υποχρεωτικά από τις 20 Ιανουαρίου 2027. Μηχανήματα που διατίθενται στην αγορά της ΕΕ πριν από αυτή την ημερομηνία παραμένουν στο καθεστώς της Οδηγίας 2006/42/ΕΚ, σύμφωνα με τη μεταβατική καθοδήγηση της Επιτροπής. Η αναμενόμενη ημερομηνία διάθεσης στην αγορά πρέπει να βρίσκεται στον φάκελο προμήθειας.

    Συχνές ερωτήσεις

    Χρειάζεται κάθε αυτόνομο ρομπότ υπηρεσιών κοινοποιημένο οργανισμό;

    Όχι. Η αυτονομία δεν αρκεί. Ελέγξτε αν το προϊόν ανήκει στο μέρος Α ή Β του παραρτήματος I και εφαρμόστε το άρθρο 25. Το μέρος Α απαιτεί διαδικασία τρίτου, ενώ τα μη καταχωρισμένα μηχανήματα χρησιμοποιούν την ενότητα Α.

    Η μηχανική μάθηση ενεργοποιεί πάντα το μέρος Α;

    Όχι. Τα σημεία 5 και 6 αφορούν πλήρως ή εν μέρει αυτοεξελισσόμενη συμπεριφορά που χρησιμοποιεί μηχανική μάθηση και εξασφαλίζει λειτουργίες ασφάλειας. Η λειτουργία και η συμπεριφορά πρέπει να προκύπτουν από τα τεχνικά αποδεικτικά.

    Μπορεί προϊόν του μέρους Β να χρησιμοποιήσει εσωτερικό έλεγχο;

    Ναι, μόνο με τις προϋποθέσεις του άρθρου 25 παράγραφος 3. Τα ειδικά εναρμονισμένα πρότυπα ή οι κοινές προδιαγραφές πρέπει να καλύπτουν όλες τις σχετικές βασικές απαιτήσεις και να έχουν εφαρμοστεί στον σχεδιασμό και την κατασκευή.

    Πώς ελέγχουμε έναν κοινοποιημένο οργανισμό;

    Αναζητήστε τον στο NANDO για τον Κανονισμό (ΕΕ) 2023/1230. Αντιστοιχίστε αριθμό αναγνώρισης, κατηγορία προϊόντος και ενότητα με το πιστοποιητικό και το υπόμνημα ταξινόμησης.

    Ένα εθελοντικό πιστοποιητικό αποδεικνύει συμμόρφωση CE;

    Όχι. Η καθοδήγηση NANDO και Επιτροπής προειδοποιεί ότι δεν πρέπει να συγχέεται με αξιολόγηση κοινοποιημένου οργανισμού στο νόμιμο πεδίο του. Ο κατασκευαστής παραμένει υπεύθυνος για τη συνολική αξιολόγηση.

    Τι κάνει το ξενοδοχείο αν ο προμηθευτής δεν εξηγεί τη διαδικασία;

    Αναστέλλει την αποδοχή και το σχετικό ορόσημο πληρωμής. Ζητά υπόμνημα ταξινόμησης, αρχιτεκτονική ασφάλειας, πίνακα προτύπων και συνεπή έγγραφα αξιολόγησης. Για άλυτα ζητήματα χρειάζεται τεχνική ή νομική συμβουλή.

  • Does Your Service Robot Need a Notified Body?

    A service robot notified body is not required merely because a sales brochure says “AI”, “autonomous” or “machine learning”. The decision turns on the product category and the function performed. Under the current consolidated Machinery Regulation (EU) 2023/1230, dated 27 July 2026, Annex I Part A captures specific higher-risk categories. Its points 5 and 6 address fully or partially self-evolving behaviour that uses machine-learning approaches to ensure safety functions. Article 25 then removes the internal-control route for those Part A categories.

    That distinction matters before a Greek hotel pays a deposit. If the robot falls within Part A, the manufacturer must use an EU type-examination followed by conformity to type, full quality assurance, or unit verification. Each route involves a notified body. If the robot is in Part B, internal production control is possible only under the conditions in Article 25(3). If it is not listed in Annex I, Article 25(4) points to internal production control. Software may still create demanding safety obligations even where it does not change the conformity route.

    Start with the function, not the vendor’s AI label

    The procurement team needs a functional description of the control system. Ask which outputs can initiate, permit, limit or stop movement. Ask which sensors feed those outputs, whether the decision logic changes after deployment, and what happens when a model, map or software package is updated. A robot that learns guest preferences is not automatically in Annex I Part A. A system that changes a safety-related stopping decision through a machine-learning approach is a different case.

    Recitals 54 and 55 of the Machinery Regulation explain the boundary. The third-party rule concerns systems with fully or partially self-evolving behaviour that use machine-learning approaches and ensure safety functions. Software that cannot learn or evolve and is programmed only to execute automated functions is outside that particular machine-learning trigger. This does not make fixed software safe by declaration. Annex III still governs essential health and safety requirements, including control-system reliability and protection against corruption.

    Do not classify from a product name. “Autonomous mobile robot” describes a market category, not an Annex I finding. The manufacturer should map the actual product against every Part A and Part B entry. A hotel robot may also contain a separately supplied safety component or logic unit. The classification must say whether the item assessed is the complete robot, an embedded system, or a component placed on the market independently.

    When a notified body is mandatory under Part A

    Article 25(2) gives three routes for machinery and related products in Annex I Part A. The first is EU type-examination under module B followed by conformity to type based on internal production control under module C. The second is full quality assurance under module H. The third is unit verification under module G. There is no stand-alone module A option for a Part A product.

    Annex I Part A point 5 covers safety components with fully or partially self-evolving behaviour using machine-learning approaches that ensure safety functions. Point 6 covers machinery that embeds such systems, where the systems have not been placed independently on the market, but only with respect to those systems. The wording is narrower than “robot with AI” and wider than a detachable software product. It asks what the system does for safety and whether its behaviour evolves through machine learning.

    The practical evidence is a notified-body record tied to the correct scope. The NANDO system lists organisations notified by Member States and the tasks for which each is notified. The Commission’s notified-body guidance says the manufacturer may choose a body legally designated for the required procedure. A current NANDO list for Regulation 2023/1230 shows product scopes and modules. A certificate from a testing company is not enough if the company is not notified for the relevant regulation, product category and module.

    Part B and unlisted machinery follow different routes

    Part B is not the same as Part A. Article 25(3) lists module A, B followed by C, H and G. Internal production control under module A is available only when the manufacturer designs and constructs the product in accordance with harmonised standards or common specifications specific to that category and those specifications cover all relevant essential health and safety requirements. If that coverage is missing, incomplete or not followed, the manufacturer must use B plus C, H or G.

    Part B includes, among other categories, logic units that ensure safety functions. That entry deserves a separate check when a robot supplier relies on a safety controller, perception unit or control package. It does not mean that every complete service robot becomes Part B merely because it contains control logic. The manufacturer should identify the product category, the boundaries of the assessed item and the standards used to claim complete coverage.

    For machinery not listed in Annex I, Article 25(4) provides module A. The manufacturer still carries out the conformity assessment, prepares Annex IV technical documentation, meets the Annex III requirements, signs the EU declaration of conformity and affixes CE marking. The EU’s conformity-assessment guidance makes the general point clearly: harmonised standards are voluntary, but the applicable legal requirements are mandatory. Choosing another technical solution does not remove the burden of proof.

    Ask for a classification pack before final payment

    A CE logo on the housing does not answer the Article 25 question. Ask the supplier for one controlled package that connects the robot’s identity to its classification, assessment route and technical evidence. The package should use the exact model, variant, software baseline and serial or batch identifiers in the commercial documents.

    Evidence item Question it must answer Reason to hold payment
    Annex I classification memo Is the product in Part A, Part B or unlisted, and why? No reasoned product-category decision
    Safety-function architecture Which sensors, logic and outputs ensure safety? AI marketing terms replace a functional description
    Learning-behaviour statement Can safety behaviour evolve after design or deployment? Updates or learning boundaries are undefined
    Conformity-route record Which Article 25 module applies? Module A is claimed without the required basis
    Notified-body evidence Does the body and scope match the category and module? The certificate is voluntary, expired or out of scope
    Standards coverage matrix Which Annex III requirements are covered and where are the gaps? Part B module A rests on partial coverage
    EU declaration and CE data Do model, manufacturer, legislation and body details agree? Identifiers conflict across documents

    The EU technical-documentation guidance explains that evidence must support the declaration and remain available to authorities. The CE-marking guidance also warns that the manufacturer, not an EU office, is responsible for compliance. Where a notified body participates in the production-control phase, its identification number appears next to the CE marking under the applicable rules.

    Use a procurement sequence that exposes gaps early

    1. Freeze the exact robot model, options, payload, speed, sensors, docking system, lift interface and software release in the request for quotation.
    2. Ask the manufacturer to identify every safety function and state whether any function uses fully or partially self-evolving machine-learning behaviour.
    3. Require a written Annex I classification for the complete robot and for independently marketed safety components or logic units.
    4. Match the selected Article 25 module to Part A, Part B or unlisted status.
    5. For Part B module A, obtain the standards and common-specification matrix showing complete coverage of relevant Annex III requirements.
    6. For a third-party route, verify the body’s live NANDO notification, product scope and module before relying on its certificate.
    7. Reconcile model names, software versions, certificate references, declaration data and CE marking before shipment.
    8. Put document delivery, update control and material configuration changes into acceptance clauses, with payment retained until the pack is consistent.

    This sequence complements a full Annex IV technical-file review. It also depends on identifying the correct service robot manufacturer. A hotel cannot fix a missing manufacturer assessment by collecting disconnected laboratory reports after delivery.

    Budget for the route, but do not invent a certification price

    The conformity route affects engineering work, evidence review, testing, audit time and change control. Module B plus C separates type examination from production conformity. Module H assesses a full quality system. Module G assesses a unit. Those differences can change commercial timing, but there is no reliable universal price or lead time for a hotel robot. Product complexity, technical-file quality, test needs, notified-body scope and the maturity of the manufacturer’s system all matter.

    A useful commercial model has four separate lines: manufacturer remediation, laboratory or specialist testing, notified-body assessment where required, and internal integration work. Keep a fifth contingency line for rework after a material software or hardware change. The Commission’s Blue Guide explains the conformity modules at a horizontal level, but the sector-specific rule in Article 25 controls the available route.

    The decision to record

    Before final payment, record the product’s Annex I category and assessment route. Part A needs a verified notified-body route. Part B needs either complete standards coverage for module A or a verified notified-body route. Unlisted machinery needs module A and a complete manufacturer assessment. If the supplier cannot identify the safety functions, learning behaviour and Article 25 route, the file is not ready for acceptance.

    The Commission states that the Regulation applies on a mandatory basis from 20 January 2027. Machinery placed on the EU market before that date remains under Directive 2006/42/EC, subject to the Commission’s stated transition guidance. The expected placing-on-the-market date therefore belongs in the procurement record.

    Frequently asked questions

    Does every autonomous service robot need a notified body?

    No. Autonomy is not enough by itself. Check whether the product falls in Annex I Part A or Part B and apply Article 25. Part A requires a notified-body route. Unlisted machinery uses module A under the Regulation.

    Does machine learning automatically trigger Annex I Part A?

    No. Points 5 and 6 concern fully or partially self-evolving behaviour using machine-learning approaches that ensures safety functions. The function and behaviour must be established from the design evidence.

    Can a Part B product use internal production control?

    Yes, but only when the Article 25(3) conditions are met. Harmonised standards or common specifications specific to the category must cover all relevant essential health and safety requirements and be applied in design and construction.

    How do we check a notified body?

    Search NANDO by Regulation (EU) 2023/1230. Match the body’s identification number, product category and conformity module to the certificate and the supplier’s classification memo.

    Is a voluntary certificate proof of CE compliance?

    No. NANDO and Commission guidance warn against confusing voluntary certificates with conformity assessment by a notified body acting within its notified scope. The manufacturer remains responsible for the complete legal assessment.

    What should a hotel do if the supplier cannot explain the route?

    Hold acceptance and the related payment milestone. Ask for the classification memo, safety-function architecture, standards matrix and matching conformity records. Use technical or legal advice for unresolved classification questions.

  • Κατασκευαστής ρομπότ: ποιος έχει την ευθύνη;

    Ένα ξενοδοχείο που αγοράζει από χώρα εκτός ΕΕ πρέπει να εντοπίσει ποιος είναι ο κατασκευαστής ρομπότ πριν πληρώσει προκαταβολή. Πρέπει επίσης να κρίνει αν το προϊόν είναι ολοκληρωμένο μηχάνημα ή ημιτελές μηχάνημα. Οι απαντήσεις καθορίζουν ποιος σχεδιάζει την ασφάλεια, ποιο μέρος του τεχνικού φακέλου εφαρμόζεται, αν απαιτούνται σήμανση CE και δήλωση συμμόρφωσης ΕΕ στο παραδιδόμενο προϊόν και ποιος ολοκληρώνει την αξιολόγηση πριν το ρομπότ λειτουργήσει στο ξενοδοχείο.

    Η ταξινόμηση δεν κρίνεται από το εμπορικό σήμα. Ένα κινεζικό εργοστάσιο μπορεί να παραμένει κατασκευαστής ενώ μια ελληνική εταιρεία είναι εισαγωγέας. Για έναν ολοκληρωτή, το άρθρο 3 προβλέπει τις περιπτώσεις της διάθεσης με δική του επωνυμία και της κατασκευής για δική του χρήση. Η δημιουργία ή ανάληψη ευθύνης για ένα τελικό σύνολο αποτελεί χωριστή υποχρέωση του κατασκευαστή του τελικού μηχανήματος. Η ουσιώδης τροποποίηση ρυθμίζεται χωριστά από το άρθρο 18. Ο τίτλος που γράφει η σύμβαση δεν αρκεί.

    Κάντε την ταξινόμηση πριν αποδεχθείτε την προσφορά

    Η Ευρωπαϊκή Επιτροπή αναφέρει ότι ο Κανονισμός (ΕΕ) 2023/1230 εφαρμόζεται υποχρεωτικά από τις 20 Ιανουαρίου 2027. Τα μηχανήματα που διατίθενται στην αγορά της ΕΕ πριν από αυτή την ημερομηνία πρέπει να συμμορφώνονται με την Οδηγία 2006/42/ΕΚ. Ο κατασκευαστής μπορεί επίσης να δηλώσει στη δήλωση συμμόρφωσης ΕΕ ότι το μηχάνημα συμμορφώνεται με τον Κανονισμό (ΕΕ) 2023/1230, όπου αυτό εφαρμόζεται. Η ομάδα προμηθειών χρειάζεται την αναμενόμενη ημερομηνία διάθεσης στην αγορά και όχι μόνο την ημερομηνία εγκατάστασης στο ξενοδοχείο. Μια καθυστέρηση αποστολής μπορεί να αλλάξει το υποχρεωτικό καθεστώς.

    Το πρώτο ερώτημα είναι αν το αντικείμενο της προσφοράς μπορεί να εκτελέσει την ειδική εφαρμογή για την οποία πωλείται. Σύμφωνα με το άρθρο 3 του ισχύοντος ενοποιημένου κειμένου, μηχάνημα είναι, μεταξύ άλλων, ένα σύνολο συνδεδεμένων μερών με τουλάχιστον ένα κινούμενο μέρος, συναρμολογημένων για συγκεκριμένη εφαρμογή. Η έννοια καλύπτει επίσης σύνολα από τα οποία λείπουν μόνο οι επί τόπου συνδέσεις, η σύνδεση με πηγή ενέργειας ή κίνησης, η εγκατάσταση σε κτίριο ή μέσο μεταφοράς, ή η φόρτωση λογισμικού για την ειδική εφαρμογή που προβλέπει ο κατασκευαστής.

    Η τελευταία περίπτωση έχει ιδιαίτερη σημασία για τα ρομπότ υπηρεσιών. Ένα κατά τα άλλα έτοιμο ρομπότ διανομής δεν γίνεται ημιτελές μόνο επειδή το ξενοδοχείο πρέπει να συνδέσει το Wi-Fi ή να χαρτογραφήσει τους ορόφους. Το ίδιο ισχύει για τη ρύθμιση κλήσης ανελκυστήρα, τη φόρτωση προφίλ χώρου ή την εγκατάσταση του προβλεπόμενου λογισμικού. Αυτές οι εργασίες μπορεί να απαιτούν έλεγχο ολοκλήρωσης, αλλά ο νομικός ορισμός του μηχανήματος περιλαμβάνει ρητά αρκετές μορφές τελικής εγκατάστασης και συμπλήρωσης λογισμικού.

    Το ημιτελές μηχάνημα έχει στενότερο ορισμό. Είναι σύνολο που δεν είναι ακόμη μηχάνημα επειδή δεν μπορεί από μόνο του να εκτελέσει συγκεκριμένη εφαρμογή και προορίζεται αποκλειστικά να ενσωματωθεί ή να συναρμολογηθεί με μηχάνημα, άλλο ημιτελές μηχάνημα ή εξοπλισμό ώστε να σχηματιστεί μηχάνημα. Οι φράσεις “δεν μπορεί από μόνο του” και “προορίζεται αποκλειστικά” χρειάζονται τεκμήρια. Δεν προκύπτουν από περιγραφές πώλησης όπως “βάση ρομπότ”, “πλατφόρμα” ή “κιτ ολοκλήρωσης”.

    Ελέγξτε τη λειτουργία και όχι την ετικέτα του πωλητή

    Ζητήστε από τον προμηθευτή να περιγράψει την προβλεπόμενη εφαρμογή σε μία πρόταση. Συγκρίνετε την πρόταση με την παραδιδόμενη διαμόρφωση. Μια κινητή βάση με κινητήρες, μπαταρίες και ελεγκτές μπορεί να είναι ημιτελής αν δεν διαθέτει τα συστήματα που απαιτούνται για οποιαδήποτε καθορισμένη εργασία και πωλείται μόνο για ενσωμάτωση. Ένα ρομπότ room service που πωλείται για μεταφορά δίσκων από την υποδοχή στα δωμάτια μπορεί ήδη να είναι μηχάνημα, παρότι τοπικός τεχνικός θα χαρτογραφήσει διαδρομές και θα συνδέσει πόρτες, ανελκυστήρες ή σταθμούς φόρτισης.

    Συνδέστε την ταξινόμηση με πίνακα υλικών, κατάλογο λογισμικού, προδιαγραφή διεπαφών και δοκιμή αποδοχής. Καταγράψτε τι μπορεί να κάνει το προϊόν κατά την παράδοση, τι θα προσθέσει το ξενοδοχείο ή ο ολοκληρωτής, ποιος σχεδίασε κάθε λειτουργία ασφάλειας, ποιος καθορίζει την τελική προβλεπόμενη χρήση και ποιος εγκρίνει την έκδοση. Το ζήτημα δεν είναι αν απομένει κάποια εργασία. Πολλά μηχανήματα απαιτούν εγκατάσταση. Το ζήτημα είναι αν το παραδιδόμενο σύνολο μπορεί να εκτελέσει τη συγκεκριμένη εφαρμογή, λαμβάνοντας υπόψη ότι το άρθρο 3 ήδη αντιμετωπίζει ορισμένες συνδέσεις, τοποθετήσεις και φορτώσεις λογισμικού ως μέρος του μηχανήματος.

    Ένα σύντομο σημείωμα προμήθειας πρέπει να απαντά στα εξής:

    • Ποια ακριβώς λειτουργία σχεδιάστηκε να εκτελεί το παραδιδόμενο σύνολο;
    • Μπορεί να την εκτελέσει μετά από συνήθη σύνδεση, τοποθέτηση, χαρτογράφηση ή φόρτωση του προβλεπόμενου λογισμικού;
    • Πωλείται αποκλειστικά για ενσωμάτωση σε μεγαλύτερο μηχάνημα του οποίου οι τελικές λειτουργίες ασφάλειας σχεδιάζονται αλλού;
    • Ποιος ελέγχει τον τελικό σχεδιασμό, την εκτίμηση κινδύνου, την έκδοση λογισμικού και την απόφαση διάθεσης;
    • Ποια νομική οντότητα θα αναγράφεται ως κατασκευαστής στο προϊόν και στη δήλωση;

    Αν οι απαντήσεις συγκρούονται με τη δήλωση του προμηθευτή, παγώστε την αποδοχή. Το λογότυπο CE, η περιγραφή του τιμολογίου ή ένα εθελοντικό πιστοποιητικό δεν λύνουν τη σύγκρουση. Η πύλη Your Europe διευκρινίζει ότι δεν υπάρχει κεντρικός φορέας της ΕΕ που εκδίδει γενική άδεια ή πιστοποιητικό CE. Ο υπεύθυνος κατασκευαστής ακολουθεί τη διαδικασία συμμόρφωσης που απαιτεί η εφαρμοστέα νομοθεσία.

    Κατασκευαστής ρομπότ και άλλοι οικονομικοί ρόλοι

    Ο ορισμός του άρθρου 3 θεωρεί κατασκευαστή το φυσικό ή νομικό πρόσωπο που κατασκευάζει προϊόν εντός του πεδίου εφαρμογής ή αναθέτει τον σχεδιασμό ή την κατασκευή και το διαθέτει με τη δική του επωνυμία ή εμπορικό σήμα. Κατασκευαστής είναι επίσης εκείνος που κατασκευάζει τέτοιο προϊόν και το θέτει σε λειτουργία για δική του χρήση. Ο κατασκευαστής ρομπότ μπορεί συνεπώς να είναι αγοραστής ιδιωτικής ετικέτας ή ολοκληρωτής στην ΕΕ, ακόμη και αν άλλο εργοστάσιο έκανε τη φυσική παραγωγή.

    Εισαγωγέας είναι το εγκατεστημένο στην ΕΕ πρόσωπο που διαθέτει για πρώτη φορά στην ενωσιακή αγορά προϊόν από τρίτη χώρα. Τα άρθρα 13 και 14 του Κανονισμού επιβάλλουν χωριστές υποχρεώσεις. Ο εισαγωγέας διαθέτει μόνο συμμορφούμενα προϊόντα, ελέγχει τα έγγραφα του κατασκευαστή και τα συνοδευτικά στοιχεία, προσθέτει τα δικά του στοιχεία ταυτοποίησης, τηρεί καθορισμένα αρχεία και συνεργάζεται με τις αρχές. Για ημιτελές μηχάνημα, ελέγχει τον φάκελο του Παραρτήματος IV Μέρος Β, τη δήλωση ενσωμάτωσης και τις οδηγίες συναρμολόγησης.

    Η εισαγωγή δεν μεταφέρει αυτόματα στον εισαγωγέα την αρχική υποχρέωση σχεδιασμού του κατασκευαστή. Δημιουργεί όμως υποχρέωση ελέγχου πριν από τη διάθεση. Ο εισαγωγέας δεν μπορεί να αντιμετωπίσει τα ελλιπή έγγραφα ως εκκρεμότητα που θα κλείσει μετά την εγκατάσταση. Ο Κανονισμός (ΕΕ) 2019/1020 παρέχει το ευρύτερο πλαίσιο εποπτείας της αγοράς, τις εξουσίες των αρχών και τα διαδικαστικά δικαιώματα των οικονομικών φορέων. Μια εμπορική υπόσχεση ότι τα έγγραφα θα δοθούν αργότερα δεν εξαλείφει την έκθεση.

    Ο εξουσιοδοτημένος αντιπρόσωπος είναι διαφορετικός ρόλος. Ο κατασκευαστής τον διορίζει με γραπτή εντολή για συγκεκριμένα καθήκοντα. Το άρθρο 12 ορίζει ότι η υποχρέωση σχεδιασμού και κατασκευής σύμφωνα με τις σχετικές απαιτήσεις ασφάλειας και η υποχρέωση σύνταξης του τεχνικού φακέλου του Παραρτήματος IV δεν μπορούν να αποτελέσουν μέρος της εντολής. Ο αντιπρόσωπος μπορεί να τηρεί τον φάκελο, να απαντά σε αιτιολογημένα αιτήματα αρχών και να συνεργάζεται σε διορθωτικές ενέργειες. Δεν μπορεί να γίνει ο συντάκτης φακέλου που ο κατασκευαστής δεν δημιούργησε.

    Η καθοδήγηση της Επιτροπής για τους κατασκευαστές και τη σήμανση CE αποδίδει στον κατασκευαστή την αξιολόγηση συμμόρφωσης, την τεχνική τεκμηρίωση, τη δήλωση συμμόρφωσης ΕΕ και τη σήμανση. Ο Γαλάζιος Οδηγός του 2022 βοηθά στον οριζόντιο διαχωρισμό των οικονομικών φορέων, αλλά αναφέρει ότι νομική ισχύ έχει το εφαρμοστέο ενωσιακό κείμενο. Για ένα ρομπότ υπηρεσιών που θα διατεθεί το 2027, προέχει ο ειδικός Κανονισμός για τα μηχανήματα.

    Τα δύο είδη προϊόντος απαιτούν διαφορετικό φάκελο

    Ερώτημα Μηχάνημα ή συναφές προϊόν Ημιτελές μηχάνημα
    Βασικός τεχνικός φάκελος Παράρτημα IV Μέρος Α Παράρτημα IV Μέρος Β
    Δήλωση κατασκευαστή Δήλωση συμμόρφωσης ΕΕ, άρθρο 21 και Παράρτημα V Μέρος Α Δήλωση ενσωμάτωσης ΕΕ, άρθρο 22 και Παράρτημα V Μέρος Β
    Σήμανση CE βάσει του Κανονισμού Τοποθετείται μετά την εφαρμοστέα αξιολόγηση Δεν αποτελεί την τελική δέσμη CE του ολοκληρωμένου μηχανήματος
    Πληροφορίες χρήστη Οδηγίες χρήσης και απαιτούμενες πληροφορίες ασφάλειας Οδηγίες συναρμολόγησης του Παραρτήματος XI
    Ποιος κλείνει την τελική αξιολόγηση Ο αναγραφόμενος κατασκευαστής του μηχανήματος Ο κατασκευαστής του τελικού μηχανήματος που ενσωματώνει τη μονάδα

    Για ολοκληρωμένο μηχάνημα, το άρθρο 10 απαιτεί σχεδιασμό και κατασκευή σύμφωνα με το Παράρτημα III, τεχνικό φάκελο του Παραρτήματος IV Μέρος Α, εφαρμογή της κατάλληλης διαδικασίας αξιολόγησης, δήλωση συμμόρφωσης ΕΕ και σήμανση CE. Η τεκμηρίωση και η δήλωση τηρούνται για τουλάχιστον δέκα έτη. Η Ergasa αναλύει το περιεχόμενο στο σημείωμα ελέγχου τεχνικού φακέλου του Παραρτήματος IV.

    Για ημιτελές μηχάνημα, το άρθρο 11 απαιτεί συμμόρφωση με τις σχετικές απαιτήσεις του Παραρτήματος III, τεκμηρίωση του Παραρτήματος IV Μέρος Β, δήλωση ενσωμάτωσης ΕΕ και οδηγίες συναρμολόγησης του Παραρτήματος XI. Το ενοποιημένο κείμενο του Κανονισμού για τα μηχανήματα επιβεβαιώνει τη διαφορετική διαδρομή εγγράφων. Η δήλωση ενσωμάτωσης δεν δηλώνει ότι το ξενοδοχείο μπορεί να χρησιμοποιήσει τη μονάδα ως τελικό μηχάνημα. Αποτελεί εισροή για τον κατασκευαστή του τελικού μηχανήματος.

    Το Παράρτημα XI απαιτεί περιγραφή των συνθηκών ορθής ενσωμάτωσης και πληροφορίες που θα χρησιμοποιηθούν στις οδηγίες του τελικού μηχανήματος. Περιλαμβάνονται σχετικά σχέδια, στοιχεία εγκατάστασης και σύνδεσης, προειδοποιήσεις, εφαρμοστέες απαιτήσεις ασφάλειας, πληροφορίες συντήρησης και η έκδοση των οδηγιών. Αν ο κατασκευαστής δηλώνει ημιτελές προϊόν αλλά δίνει μόνο γενικό εγχειρίδιο χρήσης και ένα πιστοποιητικό CE, η δέσμη αποδεικτικών στοιχείων δεν αντιστοιχεί στη δηλωμένη διαδρομή.

    Εφαρμόστε λίστα απόφασης για την προμήθεια

    1. Κλειδώστε την ταυτότητα. Καταγράψτε μοντέλο, σειρά αριθμών, έκδοση υλικού και λογισμικού, μπαταρία, φορτιστή, αισθητήρες, παρελκόμενα και ακριβή διαμόρφωση προσφοράς.
    2. Ορίστε την εφαρμογή. Δηλώστε αν το ρομπότ μεταφέρει αντικείμενα, καθαρίζει, καθοδηγεί επισκέπτες, περιπολεί ή εκτελεί άλλη λειτουργία. Συμπεριλάβετε χώρους, φορτίο, ταχύτητα, διεπαφές ανελκυστήρα και πόρτας, φόρτιση και ανάκτηση.
    3. Χαρτογραφήστε τους οικονομικούς φορείς. Λάβετε τη νομική επωνυμία και τα στοιχεία του κατασκευαστή, του τυχόν εξουσιοδοτημένου αντιπροσώπου, του εισαγωγέα και του διανομέα. Μην τους συγχωνεύετε σε ένα πεδίο “προμηθευτής”.
    4. Αμφισβητήστε τεκμηριωμένα την ταξινόμηση. Ζητήστε εξήγηση για τον χαρακτηρισμό ως μηχάνημα ή ημιτελές μηχάνημα, με αντιστοίχιση στο άρθρο 3 και στην παραδιδόμενη διαμόρφωση.
    5. Ταιριάξτε τα έγγραφα. Για μηχάνημα ζητήστε δήλωση συμμόρφωσης ΕΕ, οδηγίες και πρόσβαση στα σχετικά τεκμήρια. Για ημιτελές μηχάνημα ζητήστε δήλωση ενσωμάτωσης, οδηγίες συναρμολόγησης και τα στοιχεία του Μέρους Β που χρειάζεται ο τελικός κατασκευαστής.
    6. Ονομάστε τον τελικό κατασκευαστή. Αν τοπικός ολοκληρωτής δημιουργήσει το τελικό σύστημα, η σύμβαση πρέπει να ορίζει ποιος κάνει την τελική εκτίμηση κινδύνου, ελέγχει τις αλλαγές, δημιουργεί τον φάκελο Μέρους Α, υπογράφει τη δήλωση και τοποθετεί τη σήμανση.
    7. Ελέγξτε την αποδέσμευση. Συνδέστε την αποδοχή εγγράφων και ασφάλειας με την τελική πληρωμή και τη θέση σε λειτουργία. Μην αφήσετε το ρομπότ σε χώρους επισκεπτών ή προσωπικού όσο παραμένει ασαφής η ταξινόμηση ή ο υπεύθυνος κατασκευαστής.

    Το Νέο Νομοθετικό Πλαίσιο της Απόφασης 768/2008/ΕΚ εξηγεί την κοινή δομή των υποχρεώσεων. Οι ομάδες εισαγωγών μπορούν να χρησιμοποιούν και τη σελίδα Access2Markets για μηχανήματα και τεχνικά προϊόντα μαζί με τον τελωνειακό έλεγχο. Καμία από αυτές τις πηγές δεν αντικαθιστά την εξέταση του συγκεκριμένου προϊόντος.

    Τιμολογήστε την εργασία ολοκλήρωσης

    Η ταξινόμηση αλλάζει το κόστος. Η τιμή ολοκληρωμένου μηχανήματος πρέπει να περιλαμβάνει την εργασία συμμόρφωσης του κατασκευαστή, παρότι ο αγοραστής μπορεί να πληρώνει χωριστά την εγκατάσταση. Η αγορά ημιτελούς μηχανήματος μεταφέρει συγκεκριμένο έργο ενσωμάτωσης στον κατασκευαστή του τελικού συστήματος. Το έργο μπορεί να περιλαμβάνει σχέδια, επαλήθευση διεπαφών, τελική εκτίμηση κινδύνου, έλεγχο λογισμικού και λειτουργιών ασφάλειας, οδηγίες, τεχνικό φάκελο και υπογεγραμμένη δήλωση.

    Χρησιμοποιήστε πίνακα κόστους αντί για υποθετικό ROI:

    Γραμμή κόστους Προμηθευτής Ολοκληρωτής Ξενοδοχείο Τεκμήριο
    Σχεδιασμός και μείωση κινδύνου Ανάθεση Ανάθεση Κατά κανόνα έλεγχος Εκτίμηση κινδύνου και αρχεία σχεδιασμού
    Ανελκυστήρας, πόρτες και φόρτιση Ανάθεση Ανάθεση Περιορισμοί χώρου Σχέδια διεπαφών και δοκιμές
    Τελική αξιολόγηση συμμόρφωσης Ανάθεση Ανάθεση Δεν μένει κενό Υπεύθυνη οντότητα και διαδικασία
    Ελληνικές οδηγίες και μέτρα προσωπικού Ανάθεση Ανάθεση Εφαρμογή λειτουργίας Αποδεκτά έγγραφα και εκπαίδευση
    Αλλαγές μετά τη θέση σε λειτουργία Όροι υποστήριξης Όροι ολοκλήρωσης Έγκριση και αρχεία Αρχείο εκδόσεων και τροποποιήσεων

    Μην συμπληρώνετε τον πίνακα με εικασίες για εξοικονόμηση, νομικές αμοιβές ή τιμές δοκιμών. Ζητήστε γραπτές προσφορές για το προσδιορισμένο αντικείμενο. Η χαμηλότερη τιμή εξοπλισμού μπορεί να είναι η ακριβότερη επιλογή αν λείπει η οντότητα και η εργασία που θα μετατρέψουν το ημιτελές προϊόν σε νόμιμο τελικό μηχάνημα.

    Καταγράψτε την αβεβαιότητα και σταματήστε εγκαίρως

    Παγώστε την αποδοχή αν η δήλωση αναφέρει διαφορετικό μοντέλο ή ο προμηθευτής δεν προσδιορίζει κατασκευαστή. Κάντε το ίδιο αν ο εξουσιοδοτημένος αντιπρόσωπος καλείται να δημιουργήσει τον τεχνικό φάκελο ή το ημιτελές μηχάνημα δεν έχει οδηγίες συναρμολόγησης. Σταματήστε επίσης όταν ο τοπικός ολοκληρωτής αλλάζει λειτουργίες ασφάλειας χωρίς να αναλαμβάνει τον ρόλο του τελικού κατασκευαστή.

    Η πρακτική απόφαση είναι σαφής. Μην ρωτάτε μόνο αν το ρομπότ “έχει CE”. Ρωτήστε τι είναι το προϊόν, ποιος είναι ο κατασκευαστής, ποιο μέρος του Παραρτήματος IV εφαρμόζεται και ποιος υπογράφει για την τελική διαμόρφωση που θα λειτουργεί στο ξενοδοχείο. Ο οδηγός ετοιμότητας της Ergasa για τον Κανονισμό Μηχανημάτων δίνει την ευρύτερη σειρά προμήθειας. Το σημείωμα ταξινόμησης πρέπει να βρίσκεται στην αρχή του φακέλου, πριν από τον έλεγχο εγγράφων και την τελική πληρωμή.

    Συχνές ερωτήσεις

    Η εισαγωγή κινεζικού ρομπότ κάνει τον Έλληνα εισαγωγέα κατασκευαστή;

    Όχι αυτόματα. Ο εισαγωγέας έχει χωριστές υποχρεώσεις ελέγχου, ταυτοποίησης, τήρησης αρχείων και συνεργασίας. Εμπίπτει στον ορισμό του κατασκευαστή του άρθρου 3 αν αναθέτει την κατασκευή και διαθέτει το προϊόν με τη δική του επωνυμία ή αν κατασκευάζει για δική του χρήση. Η ευθύνη για ένα τελικό σύνολο απορρέει από τον χωριστό ρόλο του κατασκευαστή του τελικού μηχανήματος, ενώ η ουσιώδης τροποποίηση καλύπτεται από το άρθρο 18. Εξετάστε τα γεγονότα και τη σύμβαση.

    Είναι ημιτελές ένα ρομπότ επειδή χρειάζεται χαρτογράφηση και Wi-Fi;

    Αυτά τα στοιχεία συνήθως δεν αρκούν. Το άρθρο 3 περιλαμβάνει στα μηχανήματα όσα χρειάζονται συνήθεις επί τόπου συνδέσεις ή μόνο φόρτωση λογισμικού για την ειδική εφαρμογή που προβλέπει ο κατασκευαστής. Χρειάζεται εξέταση της συνολικής λειτουργίας και της μηχανικής εργασίας που απομένει.

    Μπορεί ο εξουσιοδοτημένος αντιπρόσωπος να συντάξει τον τεχνικό φάκελο;

    Το άρθρο 12 ορίζει ότι η σύνταξη της τεχνικής τεκμηρίωσης του Παραρτήματος IV δεν μπορεί να αποτελέσει μέρος της εντολής του. Ο αντιπρόσωπος μπορεί να τηρεί τον φάκελο και να τον διαθέτει στις αρχές στο πλαίσιο της γραπτής εντολής.

    Το ημιτελές μηχάνημα πρέπει να έχει την τελική δέσμη CE;

    Ο Κανονισμός προβλέπει διαφορετική διαδρομή: τεκμηρίωση Παραρτήματος IV Μέρος Β, δήλωση ενσωμάτωσης ΕΕ και οδηγίες συναρμολόγησης Παραρτήματος XI. Ο κατασκευαστής του τελικού μηχανήματος ολοκληρώνει την αξιολόγηση και τη δήλωση για το τελικό σύνολο.

    Τι κάνει το ξενοδοχείο όταν τα έγγραφα του προμηθευτή συγκρούονται;

    Παγώνει την αποδοχή και την πληρωμή που συνδέεται με τα τεκμήρια συμμόρφωσης. Κλειδώνει την ταυτότητα του προϊόντος, καταγράφει τη σύγκρουση, ζητά γραπτή ταξινόμηση βάσει του άρθρου 3 και απαιτεί διόρθωση της δέσμης πριν από τη θέση σε λειτουργία.

  • Service Robot Manufacturer: Who Carries the Duty?

    A hotel buying from outside the EU should identify the service robot manufacturer before paying a deposit. It must also decide whether the item is complete machinery or partly completed machinery. The answers determine who must design for safety, which technical file applies, whether a CE mark and EU declaration of conformity belong on the delivered product, and who must finish the assessment before the robot enters hotel service.

    This is a classification exercise, not a branding exercise. A Chinese factory can remain the manufacturer while a Greek company is the importer. For an integrator, Article 3 identifies the own-name and own-use routes: it has the product made and markets it under its own name, or it manufactures machinery for its own use. Creating or taking responsibility for a finished assembly is a separate final-machinery duty. A substantial modification is governed separately by Article 18. The contract label alone does not settle the legal role.

    Make the classification before accepting the quote

    The European Commission states that Regulation (EU) 2023/1230 applies on a mandatory basis from 20 January 2027. Machinery placed on the EU market before that date must comply with Directive 2006/42/EC. A manufacturer may also state in the EU declaration of conformity that the machinery conforms with Regulation (EU) 2023/1230 where applicable. The procurement team therefore needs the expected placing-on-the-market date, not only the hotel installation date. A delayed shipment can change the mandatory regime.

    The first decision is whether the quoted object can perform the specific application for which it is sold. Under Article 3 of the current consolidated Machinery Regulation, machinery includes an assembly with moving linked parts joined for a specific application. It also includes an assembly missing only its on-site connections, its energy or motion connection, its installation on a building or transport structure, or the upload of software intended for the application foreseen by the manufacturer.

    That last point matters for service robots. A vendor cannot turn an otherwise finished delivery robot into partly completed machinery merely because the hotel must connect Wi-Fi, map the floors, configure lift calls, load a site profile or upload the intended application software. Those facts may create integration work, but the statutory definition of machinery expressly covers several forms of final installation and software completion.

    Partly completed machinery is narrower. Article 3 says it cannot in itself perform a specific application. It must also be intended only for incorporation into or assembly with machinery, other partly completed machinery or equipment so that machinery is formed. The words “cannot in itself” and “only intended” deserve evidence. They should not be inferred from a sales description such as “robot base”, “platform” or “integration kit”.

    Use a functional test, not the vendor’s label

    Ask the supplier to state the intended application in one sentence. Then compare that statement with the delivered configuration. A mobile chassis with drives, batteries and controllers may be partly completed if it lacks the systems needed to perform any defined service task and is sold only for incorporation. A room-service robot sold to carry trays between reception and guest floors may already be machinery even though a local technician must map routes, connect doors or lifts, and configure charging.

    The classification should be tied to a bill of materials, software list, interface specification and acceptance test. Record what the product can do at delivery, what the hotel or integrator must add, who designed each safety function, and who defines the final intended use. The relevant question is not whether work remains. Most machinery requires installation. The question is whether the supplied assembly can perform its specific application, subject to the forms of connection, mounting and software completion that Article 3 already treats as machinery.

    A useful procurement memo should answer five points:

    • What exact operation is the supplied assembly designed to perform?
    • Can it perform that operation after ordinary connection, mounting, mapping or intended software upload?
    • Is it sold only for incorporation into a larger machine whose final safety functions are designed elsewhere?
    • Who controls the final design, risk assessment, software version and release decision?
    • Which entity’s name and address will appear as manufacturer on the product and declaration?

    If the answers conflict with the declaration supplied by the vendor, hold acceptance. A CE logo, invoice description or voluntary certificate does not resolve a classification conflict. Your Europe warns that there is no central EU body issuing permission or a general CE certificate; the responsible manufacturer must follow the conformity route required by the applicable legislation.

    Identify the service robot manufacturer and the other roles

    The Machinery Regulation’s Article 3 definition covers a person that manufactures a product or has it designed or manufactured and markets it under its name or trademark. It also covers a person that manufactures the product and puts it into service for its own use. The service robot manufacturer can therefore be an EU private-label buyer or integrator, even when another factory performs the physical production.

    An importer is the EU-established person that places a product from a third country on the Union market. Import status carries its own duties. Under Articles 13 and 14, the importer must place only compliant products on the market, verify the required manufacturer documentation and accompanying documents, add importer identification, preserve specified records, and cooperate with authorities. For partly completed machinery, that includes checking the Annex IV Part B documentation, declaration of incorporation and assembly instructions.

    Importing does not automatically transfer the original manufacturer’s design duty to the importer. It does, however, create a gatekeeping duty. The importer cannot treat missing documentation as a task to be postponed until after the robot reaches the hotel floor. Regulation (EU) 2019/1020 supplies the wider market-surveillance framework, including authority powers and procedural rights. A commercial promise to obtain documents later does not remove the product-law exposure.

    An authorised representative is different again. The manufacturer appoints it through a written mandate for specified tasks. Article 12 is explicit that the duty to design and construct in accordance with the relevant safety requirements and the duty to draw up the Annex IV technical documentation cannot form part of that mandate. The representative may keep the file, answer reasoned authority requests and cooperate on corrective action. It does not become the author of a file that the manufacturer never created.

    The Commission’s CE guidance for manufacturers assigns conformity assessment, technical documentation, the EU declaration of conformity and CE marking to the manufacturer. The 2022 Blue Guide is useful for the horizontal distinction between manufacturer, authorised representative, importer and distributor, but it also says that only the applicable Union act has legal force. For a 2027 service robot, the machinery-specific text controls where it differs.

    Complete and partly completed products require different evidence

    Question Machinery or related product Partly completed machinery
    Core technical file Annex IV Part A Annex IV Part B
    Manufacturer statement EU declaration of conformity under Article 21 and Annex V Part A EU declaration of incorporation under Article 22 and Annex V Part B
    CE marking under the Machinery Regulation Affixed after the applicable conformity assessment Not treated as the final machinery’s CE-marked declaration package
    User information Instructions for use and required safety information Assembly instructions under Annex XI
    Who completes the final machine assessment? The manufacturer named for the machinery The manufacturer of the final machinery that incorporates the partly completed unit

    For complete machinery, Article 10 requires the manufacturer to design and construct against Annex III, draw up Annex IV Part A technical documentation, perform the applicable conformity assessment, issue the EU declaration of conformity and affix CE marking. The documentation and declaration must remain available for at least ten years. The exact file contents are covered in Ergasa’s Annex IV technical-file review.

    For partly completed machinery, Article 11 requires compliance with the relevant Annex III requirements, Annex IV Part B technical documentation, an EU declaration of incorporation and Annex XI assembly instructions. The consolidated Machinery Regulation confirms this different document route. The declaration of incorporation is not a declaration that the hotel may use the assembly as finished machinery. It is an input into the final machinery manufacturer’s work.

    Annex XI requires the assembly instructions to describe the conditions for correct incorporation and to supply information needed for the final machinery’s instructions. That includes relevant drawings, installation and connection information, warnings, applicable safety requirements, maintenance information and the version of the instructions. If an OEM claims partly completed status but supplies only a generic user manual and a CE certificate, the evidence package does not match the claimed route.

    Run a hotel procurement decision checklist

    1. Freeze identity. Record model, serial-number scheme, hardware revision, software version, battery and charger, sensors, accessories and the exact quoted configuration.
    2. Define the application. State whether the robot transports items, cleans, guides guests, patrols or performs another operation. Include operating areas, payload, speed, lift and door interfaces, charging and recovery.
    3. Map economic operators. Obtain the legal name and contact details of the manufacturer, authorised representative if any, importer and distributor. Do not merge them into a single “supplier” field.
    4. Challenge the classification. Ask why the product is machinery or partly completed machinery. Require the supplier to map the answer to Article 3 and the delivered configuration.
    5. Match the documents. For machinery, request the EU declaration of conformity, instructions and access to the relevant conformity evidence. For partly completed machinery, request the declaration of incorporation, assembly instructions and the Part B evidence needed by the final machinery manufacturer.
    6. Name the final manufacturer. If a local integrator will create the finished assembly, the contract must say who performs the final risk assessment, controls changes, creates the Part A file, signs the declaration and affixes the CE mark.
    7. Control release. Make document acceptance and functional safety acceptance conditions for final payment and commissioning. Do not release the robot into guest or staff areas while the classification or responsible manufacturer remains unresolved.

    The broader New Legislative Framework in Decision No 768/2008/EC explains the common structure behind economic-operator duties. Import teams can also use the Commission’s Access2Markets machinery page to identify product requirements alongside customs work. Neither source replaces the product-specific review.

    Price the integration duty instead of hiding it

    The classification changes cost. A quote for complete machinery should include the manufacturer’s conformity work in the product price, even if the buyer still pays for site installation. A quote for partly completed machinery transfers a defined incorporation job to the final machinery project. That job can require engineering drawings, interface validation, a final risk assessment, software and safety-control verification, instructions, technical documentation and a signed declaration.

    Use a simple cost schedule rather than an invented ROI claim:

    Cost line Supplier quote Local integrator Hotel Evidence required
    Product design and risk reduction Assign Assign Normally review only Risk assessment and design records
    Lift, door and charging integration Assign Assign Provide site constraints Interface drawings and tests
    Final conformity assessment Assign Assign Do not leave blank Named responsible entity and procedure
    Greek instructions and staff controls Assign Assign Operational implementation Accepted documents and training record
    Change control after commissioning Support terms Integration terms Approval and records Version and modification log

    Do not populate the schedule with guessed savings, legal fees or testing prices. Obtain written quotes against the identified scope. The lowest equipment price can be the most expensive offer if it omits the entity and work needed to turn partly completed machinery into lawful finished machinery.

    Record uncertainty and stop at the right boundary

    Several facts should trigger a hold. Stop if the declaration names a different model or the supplier refuses to identify the manufacturer. Stop if a claimed authorised representative is expected to create the technical file, partly completed machinery has no assembly instructions, or the local integrator will change safety functions without accepting final-manufacturer responsibility.

    The practical outcome is simple. Do not ask only whether the robot has CE. Ask what the product is, who the manufacturer is, which Annex IV file applies, and who signs for the finished configuration that will operate in the hotel. Ergasa’s Machinery Regulation readiness guide for Greek hotels provides the wider procurement sequence. This classification memo should sit at the front of that file, before document review and before final payment.

    Frequently asked questions

    Does importing a Chinese service robot make the Greek importer the manufacturer?

    Not automatically. The importer has separate verification, identification, recordkeeping and cooperation duties. It falls within the Article 3 manufacturer definition if it has the product made and markets it under its own name or trademark, or manufactures for its own use. Responsibility for a finished assembly arises from the separate final-machinery role, while substantial modification is addressed by Article 18. Review the facts and contract, not only the invoice label.

    Is a robot partly completed because it still needs mapping and Wi-Fi setup?

    Usually those facts alone are not enough. Article 3 includes machinery missing ordinary on-site connections and machinery missing only the upload of software intended for the manufacturer’s specific application. The full delivered function and remaining engineering work still need review.

    Can an authorised representative draw up the technical file?

    Article 12 says the obligation to draw up the Annex IV technical documentation cannot form part of the authorised representative’s mandate. The representative may keep the file and provide it to authorities under the written mandate.

    Should partly completed machinery carry the final machinery CE package?

    The Machinery Regulation gives it a different route: Annex IV Part B technical documentation, an EU declaration of incorporation and Annex XI assembly instructions. The manufacturer of the finished machinery completes the final assessment and declaration for that final assembly.

    What should a hotel do when the supplier’s documents conflict?

    Hold acceptance and payment tied to compliance evidence. Freeze the product identity, list the conflict, obtain a written classification mapped to Article 3, and require the responsible manufacturer or importer to correct the package before commissioning.

  • Machinery technical file: Annex IV review

    Machinery technical file: what Annex IV requires

    A CE mark is not a substitute for the machinery technical file. For a hotel buying a service robot, the useful question is whether the manufacturer’s evidence shows how this exact machine was designed, assessed and verified. Regulation (EU) 2023/1230 makes that evidence a manufacturer obligation before the machine is placed on the market or put into service. A buyer or importer should inspect the file systematically before final acceptance, without pretending that a commercial review is a conformity certificate.

    Make the acceptance decision before relying on the CE mark

    The decision job is practical: when an OEM or importer claims CE for a service robot, identify what is present, missing or inadequate in the Annex IV technical documentation before accepting the machine. The mark belongs at the end of a compliance process, not at the beginning of a buyer’s investigation. The European Commission’s CE-marking guidance explains that manufacturers are responsible for assessing conformity, setting up the technical file, issuing the declaration and affixing the mark where the applicable rules require it.

    The timing also matters. The Commission’s machinery overview distinguishes the current Machinery Directive from Regulation (EU) 2023/1230 and notes the corrected application timetable. The consolidated Regulation applies from 20 January 2027, subject to provisions with different dates. A procurement file should state which legal regime applies when the product is first placed on the market or put into service. It should not mix a 2006/42/EC declaration with 2023/1230 document labels as if the transition were merely cosmetic.

    For hotel management, the acceptance outcome should be one of four states. Evidence may be accepted for the agreed review scope, accepted subject to named close-out items, or held pending material evidence. Rejection is appropriate when the product identity, conformity route or safety case cannot be reconciled. That classification is more useful than a binary “CE received” checkbox. It also preserves a record of what management knew before payment and deployment.

    Separate the duties of manufacturer, importer and hotel

    Article 10 of the consolidated Machinery Regulation requires the manufacturer to design and construct machinery or a related product against Annex III. Before market placement or first use, the manufacturer must also draw up the Annex IV Part A technical documentation and complete the relevant Article 25 conformity-assessment procedure. The same article requires retention of the documentation and EU declaration of conformity for at least ten years. Where necessary for an authority’s compliance check, source code or programming logic may have to be made available on a reasoned request.

    An authorised representative can hold documents and cooperate with authorities under a written mandate, but Article 12 does not allow the manufacturer’s core duties to be delegated away. Article 13 gives an importer a separate gatekeeping role. Before placing machinery from outside the Union on the market, the importer must ensure the appropriate procedure was completed and the manufacturer drew up the Annex IV Part A file. The importer must also check the required marking and accompanying documents, retain the declaration, and ensure the technical documentation can be made available to authorities.

    A Greek hotel that buys from an EU distributor is not automatically the importer. A hotel that buys directly from a non-EU OEM may become the importer, depending on the transaction and market-placement facts. A hotel can also become the manufacturer for regulatory purposes if it manufactures for its own use or makes a substantial modification within the Regulation’s rules. These roles must be established from contracts, invoices, customs records, product labels and the actual modification scope, not from the supplier’s sales terminology.

    The hotel remains an employer and operator with workplace, installation, maintenance and safe-use duties even when it is not the product manufacturer. Ergasa’s Machinery Regulation readiness guide for Greek hotels places the technical file within that broader deployment decision. A clean manufacturer file does not replace site-specific route testing, staff controls, lift integration review or emergency arrangements.

    Check the Annex IV Part A contents against the exact robot

    Annex IV Part A is not a request for every engineering record ever produced. It specifies enough documentation to demonstrate conformity and enable authorities to assess the machine. The file begins with a complete description of the machinery or related product and its intended use. It should identify the model, type, serial or configuration boundaries and explain foreseeable misuse. For a mobile hotel robot, the description should match the delivered sensors, batteries, payload modules, chargers, software version and optional lift or door integrations.

    The file then needs overall and detailed drawings and the schemes, calculations, test results, certificates and explanations required to understand operation and verify conformity. The risk-assessment documentation must show the procedure followed: the applicable essential health and safety requirements, identified hazards, protective measures, residual risks and the outcome of design choices. A generic corporate risk-policy PDF is not the same thing as the product’s risk assessment.

    The documentation must identify the specifications applied. These may include harmonised standards, common specifications or other technical specifications, with the essential requirements covered. The Commission’s machinery standards page is the correct place to verify published references for the current machinery regime. Under Regulation (EU) 1025/2012, European standardisation operates within a formal legal framework; a supplier’s standards list still has to identify editions, amendments and the requirements actually addressed.

    Annex IV also calls for reports giving results of tests performed by the manufacturer or by a body selected by it. It requires a copy of the instructions for use and the EU declaration of conformity, plus evidence for series production where applicable. If partly completed machinery is incorporated, the relevant declarations of incorporation and assembly instructions belong in the evidence chain. The file may also need the EU declarations for incorporated products governed by other Union harmonisation legislation.

    Annex IV evidence area Buyer’s inspection question Material warning sign
    Product description and identity Does it match the delivered hardware, software and options? One file covers several undefined configurations.
    Drawings, schemes and calculations Can a competent reviewer understand safety-related systems? Only sales diagrams or manuals are supplied.
    Risk assessment Are hazards, requirements, measures and residual risks traceable? A generic checklist has no model-specific evidence.
    Specifications and standards Are editions and covered requirements identified? Logos or standard numbers appear without a compliance map.
    Verification and test reports Do methods, samples, acceptance criteria and results align? Certificates cannot be linked to the delivered model.
    Instructions and declarations Are language, identity and integration documents consistent? Names, model codes or legal regimes conflict.
    Series-production controls How is continuing conformity maintained after changes? No software, supplier or production change control is shown.

    Test traceability, software and change control

    A file can contain every expected heading and still be inadequate. The decisive quality is traceability: each applicable Annex III requirement should connect to a hazard or design issue, a protective measure, a specification or engineering rationale, and verification evidence. Test reports should identify the tested unit or representative sample, configuration, software version, method, acceptance criteria, date and result. If the test laboratory is external, its scope and report identity should be checked rather than inferred from a logo.

    For connected and software-driven robots, the review should establish which software affects safety functions, who controls updates and how changes are assessed. Annex IV expressly contemplates source code or programming logic needed to understand conformity, while Articles 10 and 13 permit competent authorities to request relevant code or logic where necessary for checking Annex III compliance. A hotel does not need unrestricted source-code ownership to ask for a credible safety-software configuration record, update policy and authority-access arrangement.

    Machine learning, remote diagnostics and cloud services should not be treated as one undifferentiated “AI” feature. The file should state which functions influence movement, speed, stopping, obstacle detection, payload stability, access control or other safety outcomes. It should distinguish fixed automation from behaviour that changes after deployment. The applicable conformity route is a separate decision, and the Commission’s NANDO system can be used to verify whether a named notified body is actually notified for the relevant legislation and conformity tasks.

    Change control matters because the delivered robot may not be the version that was originally tested. Review the chain from design baseline to serial production: component substitutions, battery changes, sensor revisions, safety-parameter changes, firmware releases and integration scripts. The file should explain how the manufacturer decides whether a change requires new risk assessment, testing, documentation or conformity action. A version mismatch is not automatically non-compliance, but an unexplained mismatch is a procurement hold.

    Review the machinery technical file with an evidence matrix

    Start with a controlled index rather than an email attachment folder. Record document title, owner, version, date, language, product identifier, applicable requirement, confidentiality restrictions and review result. Mark each item present, missing, inconsistent, insufficient or not applicable with a reason. “Confidential” should trigger an access arrangement, not an automatic pass. The Regulation requires the file to be available to competent authorities, while commercial review can use secure rooms, redacted copies or specialist attestations where full disclosure to the hotel is not proportionate.

    The 2022 Blue Guide is useful for the horizontal concepts behind EU product rules, including economic operators, conformity assessment, technical documentation and market surveillance. It should be read with the machinery-specific Regulation rather than used to overwrite it. The legal hierarchy also matters: a standard can support a presumption for requirements within its scope, but it does not replace the manufacturer’s responsibility to identify all applicable requirements and address uncovered risks.

    Do not ask a supplier to “send the technical file” without defining the acceptance test. A better machinery technical file request asks for the controlled Annex IV index, product-identity matrix, risk-assessment map, applied-specification register, verification plan and reports, declarations, instructions, software baseline and production-change process. It also states the review language, secure-access method, response deadline and people authorised to resolve gaps.

    Decision checklist before final payment

    • Confirm whether the delivered unit is complete machinery, a related product or partly completed machinery.
    • Record the manufacturer, importer, authorised representative and distributor from primary documents.
    • Match model, serial number, modules, charger, battery, sensors and software baseline across the file.
    • Map Annex III requirements to hazards, measures, specifications and verification evidence.
    • Check test scope, sample identity, methods, acceptance criteria, dates and unresolved failures.
    • Reconcile instructions, declarations, labels and technical documentation in the required languages.
    • Verify any notified body and its notified scope directly in NANDO.
    • Log every gap with an owner, evidence required, due date and effect on acceptance.
    • Keep final payment and deployment conditional on closure of material safety or identity gaps.
    • Archive the reviewed baseline and define notification rules for later hardware or software changes.

    Classify gaps by decision impact and closing work

    Not every missing page has the same consequence. An administrative gap may be a correctable identifier, translation or signature issue. A traceability gap arises when a report, certificate or drawing cannot be tied to the exact product. A technical gap exists when a hazard, requirement, protective measure or test is absent or inadequately supported. A conformity-route gap appears when the chosen assessment procedure or notified-body involvement cannot be justified. A role gap exists when the manufacturer or importer identity is uncertain.

    Closing work should be described without inventing a price or completion date. It may require document correction, engineering analysis, a model-specific risk assessment, testing, translation, software-baseline evidence, production-control records or an independent conformity-assessment review. The buyer should obtain a scoped proposal from a competent provider. A spreadsheet estimate is not proof that the machine can be brought into conformity.

    The enforcement context is real. Regulation (EU) 2019/1020 establishes the Union framework for market surveillance and product-compliance controls, while Regulation (EC) 765/2008 provides rules on accreditation and market surveillance. The common product-marketing framework in Decision 768/2008/EC helps explain why traceable economic operators and reliable declarations recur across EU harmonisation laws. These instruments do not let a hotel declare a robot compliant; they show why a weak file can become an operational and commercial problem after import.

    There is also a cash decision. Technical-file access and gap closure should be included in the purchase terms before the hotel loses leverage. Milestones can tie deposits, shipment, customs release, site acceptance and final payment to named evidence. The financial model should include specialist review and retesting as contingent costs rather than assert that every robot will incur them. For a wider capex view, Ergasa’s hotel-robot funding and cash-timing analysis shows why eligibility and reimbursement assumptions must remain separate from compliance evidence.

    Set a defensible next step

    Before accepting a hotel service robot, request a controlled Annex IV Part A index and build the evidence matrix against the exact delivered configuration. Resolve identity, role and conformity-route questions first; they determine what the rest of the file must prove. Escalate material safety, software and verification gaps to competent engineering or conformity-assessment specialists. Keep the review conclusion narrow: it records procurement evidence and unresolved questions at a date. It is not the manufacturer’s declaration, a notified-body certificate or legal advice.

    Uncertainty must remain visible. The Regulation’s classification and conformity procedures can turn on product-specific facts that a sales brochure does not disclose. Harmonised-standard references and notified-body scopes can change. Software updates can alter the assessed baseline. The only defensible acceptance record is therefore one that names its assumptions, identifies the reviewed configuration, dates every source and keeps open items attached to an owner and decision.

    Frequently asked questions

    Must the manufacturer give the whole technical file to the hotel?

    The Regulation requires the manufacturer to draw up and retain the file and make it available to competent authorities. It does not create a simple rule that every buyer receives every confidential engineering record. The purchase contract should secure enough controlled access for due diligence, operation, integration and regulatory cooperation, using a secure review arrangement where justified.

    Does a CE mark prove the Annex IV file is complete?

    No. The mark indicates the manufacturer’s claim that applicable requirements have been met. A buyer should still reconcile product identity, declaration, conformity route, instructions and supporting evidence. The review does not itself certify compliance.

    Can an importer rely only on the supplier’s declaration?

    Article 13 requires the importer to ensure that the relevant procedure was carried out, the manufacturer drew up the required documentation, the marking is present and required documents accompany the product. The depth of a reasonable check depends on the product and evidence, but the statutory duty is more than filing a supplier email.

    Is a list of harmonised standards enough?

    No. The list should identify editions and connect each standard to requirements and evidence. Standards support conformity only within their scope. Uncovered hazards and requirements still need an engineering rationale and verification.

    What should happen when software changes after acceptance?

    The contract and manufacturer’s change process should identify safety-relevant updates, preserve version records, assess their effects and define when testing, risk assessment, documentation or conformity action must be repeated. The hotel should not silently accept an untraceable baseline change.

  • ΕΣΠΑ co-funding for service robots: the 2027 timing problem

    Service robots in Greek hotels: ΕΣΠΑ co-funding and the 2027 deadline

    Service robots in Greek hotels can present a plausible investment case and still fail both the funding test and the compliance test. The two clocks are separate: an ΕΣΠΑ call must be open and fit the applicant, while Regulation (EU) 2023/1230 changes the machinery framework from January 2027. Procurement should be built around both, without assuming that a grant is available.

    Service robots in Greek hotels face two clocks

    The phrase “fund the robot before 2027” compresses two different decisions into one. The first is financial: does an active ΕΣΠΑ 2021–2027 call, Development Law scheme or financing instrument cover the hotel, the proposed equipment and the supporting software or integration work? The second is regulatory: which machinery regime applies when the configured robot is placed on the EU market or put into service?

    The year 2027 in this article is primarily a regulatory date. The official text of Regulation (EU) 2023/1230 on machinery sets the new framework. Because the regulation has been corrected since publication, a hotel and its advisers should check the current consolidated text and the exact application date shown there rather than repeat a date from an old brochure. The key operational point does not change: a project delivered around the transition must document which regime applies to each unit. Purchase-order date alone is not enough.

    ΕΣΠΑ 2021–2027 is a programming period, not a promise that a hotel can submit a robotics application at any time until the end of 2027. Every action has its own opening window, budget, eligible activities, expenditure rules and implementation timetable. A closed action can still be in implementation for approved beneficiaries while being unavailable to new applicants.

    What the previous digital-transformation action proves

    The official Digital Transformation of Cutting-Edge SMEs action is useful evidence because it explicitly listed robotic systems, automation equipment, software and integration services among indicative expenditure categories. It also shows why headline eligibility is not enough. The action required, among other conditions, an eligible activity code, prior operation, at least nine annual work units in the preceding year, a digital-maturity score and no start of work before the funding application.

    Its published investment range was €200,001 to €1.2 million, with aid intensity from 25% to 60% depending on the aid regime, region, enterprise size and expense. Those percentages should not be copied into a 2026 hotel business case as available cash. The ΕΦΕΠΑΕ action page marks the submission period as inactive and records the closing date as 22 March 2024. Later amendments concern approved projects and implementation; they do not reopen the call to a new applicant.

    This distinction matters. A hotel may reasonably conclude that service robots can fit the type of digital investment public programmes have supported. It cannot conclude that a current grant will pay for a specific robot. Before budgeting co-funding, the hotel should verify a live invitation on the official ΕΣΠΑ portal or the relevant managing authority, then test the current terms line by line. Where a live call requires electronic submission, the official programme page should link to the OPSKE application system; the system itself does not establish eligibility.

    Build an eligible project, not a shopping list

    A grant application normally evaluates an investment plan. “Buy two delivery robots” is not yet a plan. The hotel needs a defined operational problem, a current-state baseline, measurable outputs, an implementation schedule and evidence that the proposed expenditure belongs to the call’s categories.

    For a room-service or linen-delivery robot, the project file should map the full system:

    • robot hardware, charging equipment, batteries and accessories;
    • fleet-management software, licences, hosting and support periods;
    • lift, door, access-control, telephony or property-management-system integration;
    • network changes, cybersecurity controls and guest-data handling;
    • site survey, mapping, installation, training, testing and acceptance;
    • maintenance, spare parts, uptime commitments and end-of-contract costs.

    Each line then needs a funding treatment: eligible, potentially eligible, capped, excluded or awaiting clarification. The robot’s commercial quote is not proof of eligibility. The detailed invitation, annexes, eligible activity-code list, state-aid basis and official clarifications control the answer.

    Timing can invalidate an otherwise sound project. The earlier cutting-edge action stated that work could not begin before submission and set the eligibility start at the application date. A deposit, binding order, signed implementation contract or other commitment may count as start of work under the applicable rules. The hotel should obtain programme-specific advice before committing, not after paying the supplier.

    Model cash timing before the subsidy

    Public support changes project economics, but reimbursement is not the same as a discount at checkout. A hotel may need to fund VAT, supplier deposits, non-eligible costs and the grant portion until verification and payment. Delays, corrections or rejected expenditure can widen that gap.

    Use at least three cases:

    1. No grant: the project must survive on operating economics and available finance.
    2. Expected support: use only the rate and eligible-cost base supported by the live invitation.
    3. Stress case: delay reimbursement, exclude disputed lines and include additional integration or compliance costs.

    The model should separate total project cost, eligible expenditure, public support, private contribution, VAT timing, financing cost and working-capital peak. A 50% aid rate does not mean the hotel pays half of the supplier’s total invoice. The rate may apply only to eligible costs, and the project can contain caps or excluded items.

    Where no suitable grant is open, financing instruments may still matter. The Competitiveness Programme describes Entrepreneurship Fund III as providing investment loans, guarantees and microcredit. These are financing tools, not grant substitutes. They change interest, collateral or risk-sharing economics, but the principal remains repayable.

    Development Law is a separate route

    Greece’s official private-investment portal states that Development Law 4887/2022 supports digital and technological transformation, Industry 4.0, robotics, artificial intelligence and tourism investments. It offers different incentives, including tax exemptions, cash grants, leasing subsidies and employment subsidies, subject to the specific scheme and applicant.

    That general framework is not an approval for a hotel robot. Schemes open through separate calls. The investment size, eligible tourism category, regional-aid map, enterprise size, incentive type and cumulation rules must be checked against the current scheme. A project should not combine ΕΣΠΑ and Development Law assumptions on the same cost line without a documented state-aid analysis.

    The practical approach is to maintain one investment model and test it against multiple routes. Change the funding source, not the underlying facts. The equipment list, supplier evidence, implementation dates, jobs, operating benefits and risks should remain consistent across versions.

    The 2027 machinery gate belongs in the funding file

    A subsidised robot is still a regulated product. Funding approval does not validate CE evidence, the importer, the intended use or a later modification. The procurement file should therefore carry a separate conformity track.

    For each proposed robot, ask for the exact manufacturer and model, intended purpose, EU declaration, applicable legislation, standards, instructions, serial or type identifiers, EU economic operator and conformity-assessment route. The European Commission’s CE-marking guidance explains that the manufacturer is responsible for identifying requirements, preparing technical documentation, issuing the declaration and affixing the mark. A logo on the machine is not a financing or quality certificate.

    The delivery date must be aligned with the relevant machinery regime. A project approved in 2026 may deliver units after the 2027 transition. The contract should specify which legal framework and declaration form will apply on delivery, who updates the documentation, and what happens if the supplier cannot provide an acceptable evidence pack.

    Integration can change the risk. Lift interfaces, automatic doors, payload changes, speed settings, new sensors or locally developed software may affect the configured system. The hotel should assign design, testing and change-control responsibility before installation. For a broader explanation, see Ergasa’s service-robot 2027 readiness analysis and the regulatory tracker.

    A procurement sequence that protects both files

    1. Define the operating case. State the route, task, shift, payload, interfaces, users and current cost baseline.
    2. Screen live funding routes. Check current official calls, status, dates, activity codes, region, enterprise size and minimum project budget.
    3. Freeze the start-of-work gate. Do not place a deposit or binding order until the applicable rule is confirmed.
    4. Request comparable supplier evidence. Use one template for equipment, software, integration, training, support, conformity documents and delivery dates.
    5. Model cash and risk. Calculate no-grant, expected-support and stress cases, including VAT and reimbursement timing.
    6. Resolve the 2027 regime. Link expected placement and commissioning dates to the supplier’s declaration and documentation plan.
    7. Contract for verification. Make payment and acceptance conditional on the evidence, tests and interfaces that matter.
    8. Keep two audit trails. The funding file proves eligible expenditure and outputs; the product file proves identity, conformity evidence, integration control and safe operation.

    Questions hotel owners should ask

    Is there an active ΕΣΠΑ grant for hotel service robots today?

    Do not assume so from the 2021–2027 programme name or an old adviser’s page. The previous cutting-edge digital-transformation action listed robotic systems but is inactive for new submissions. Check the official live invitation and eligible activity codes before treating support as available.

    Does a past 25%–60% aid range apply to my hotel?

    No automatic rate follows from the technology. The applicable percentage depends on the live aid scheme, region, enterprise size, expenditure category and other conditions. The eligible-cost base can also be lower than the total project cost.

    Can I order the robot before applying?

    That can create a start-of-work problem. The answer depends on the specific call and state-aid rules. Confirm the boundary in writing before making a binding commitment or paying a deposit.

    Does funding approval prove the robot is compliant?

    No. Funding bodies assess the project under their programme rules. Product conformity, importer duties, documentation, workplace risks, cybersecurity and data protection remain separate obligations.

    What should happen if delivery crosses into 2027?

    The contract should identify the expected placement and commissioning dates, the applicable machinery framework, the declaration and instructions to be delivered, and the remedy if the evidence does not match the supplied configuration. Legal review may be needed for the exact transition facts.

    The decision rule

    For service robots in Greek hotels, treat co-funding as a conditional financing source, not as the reason to buy. The robot should have a defensible operating case before support, a project design that fits an open call, enough liquidity to survive reimbursement timing, and a procurement file ready for the 2027 machinery transition. If one of those four elements is missing, the next step is evidence gathering, not supplier commitment.

    Service robots in Greek hotels: 2027 readiness

    For service robots in Greek hotels, the immediate decision is not whether robotics looks promising. It is whether the procurement route, conformity evidence, integration plan and total cost remain defensible when Regulation (EU) 2023/1230 becomes generally applicable on 20 January 2027.

    1. Start with the decision, not the demonstration

    A hotel considering a service robot should first identify who supplies it into the EU, who changes it and what evidence will exist on the placement date. A demonstration or CE logo alone cannot prove that the configured, integrated machine satisfies every applicable requirement.

    The corrected consolidated text of the Machinery Regulation (EU) 2023/1230 applies generally from 20 January 2027. Machinery placed on the EU market before that date may follow the transition rule and comply with Directive 2006/42/EC. “Ordered before” and “placed on the market before” are not automatically the same event; contract timing, transfer and the specific supply facts should be checked.

    A 2026 unit placed on the market before the change may sit under the Directive; a later unit may sit under the Regulation. A multi-year contract should identify the regime, required evidence and change owner for each unit. The Commission’s machinery page is an official starting point, but the legal text and product facts control.

    Record the model and intended purpose, EU manufacturer or import route, expected placement date, hotel-specific changes and entity named on the declaration. Keep this beside the quotation. Ergasa’s regulatory tracker supports date monitoring; the about page explains the site’s analytical scope.

    2. What the Regulation verifies and what it does not

    Article 10 places core duties on the manufacturer: design and construction in accordance with applicable essential health and safety requirements, technical documentation, the applicable conformity-assessment procedure, an EU declaration of conformity and CE marking. The manufacturer must retain the technical documentation and declaration for at least ten years after the machinery is placed on the market or put into service, as applicable.

    Article 10 permits digital instructions subject to access, download, saving and identification conditions. They must remain available for the expected lifetime and at least ten years. A free paper copy must be supplied within one month if requested at purchase. Require durable access and a controlled local copy.

    CE marking is the manufacturer’s declaration that the product meets applicable EU requirements; it is not an EU quality award. The conformity route under Article 25 depends on whether the machinery falls within an Annex I category and on the use of relevant harmonised standards or common specifications. It is inaccurate to say that every hotel service robot needs a notified body. When third-party involvement is required or claimed, the body and scope can be checked in the official NANDO database.

    Harmonised standards can provide a presumption of conformity for requirements they cover, but version and scope matter. Consult the Commission’s machinery standards information, then map the supplier’s standards list to collision, crushing, stability, charging, emergency stopping, control failure and guest interaction.

    3. Importer versus hotel buyer: assign the right role

    Not every hotel buyer is an importer. Article 13 applies when an EU-established person places machinery from a third country on the EU market. Article 15 separately covers distributors. A hotel buying from an established EU distributor may be an end user rather than the importer, although it still has contractual, workplace-safety, installation, maintenance and operational responsibilities. The supply chain must be documented rather than inferred from an invoice heading.

    Practical responsibility split to confirm before purchase
    Question Direct EU importer Hotel buying from an EU supplier
    Pre-market checks Under Article 13, place only compliant machinery; verify manufacturer conformity assessment, technical documentation, CE marking and required accompanying documents. Request and review the declaration, instructions, model identity and supplier role; do not represent itself as importer unless the facts make it one.
    Identity and contact Indicate importer name, registered trade name or trademark, postal address, website, email or other digital contact as required. Keep supplier and responsible economic-operator details in the procurement file.
    Instructions and handling Ensure required instructions and information accompany the machinery; protect compliance during storage and transport. Ensure staff can access understood instructions; control hotel-side storage, charging, routes and operation.
    Problems and cooperation Take corrective action where needed and cooperate with competent authorities, including information provision. Stop unsafe use, notify the supplier, preserve logs and cooperate with the responsible parties and authorities.
    Changes or rebranding May become the manufacturer under Article 17 when marketing under its own name or trademark, or modifying a product in a way that may affect compliance. Must assess whether its own integration or modification is substantial; title as “buyer” does not remove Article 18 consequences.

    Article 18 makes a person carrying out a substantial modification the manufacturer for that machinery, subject to manufacturer obligations and conformity assessment. Changed payloads, speed, lift access, safety sensors or behaviour should enter change control. Not every parameter adjustment is substantial; the impact needs documented technical judgment.

    Article 19 requires economic operators to retain supplier-and-customer traceability for at least ten years. An end-user hotel is not automatically an economic operator, but equivalent records are prudent. Also consider Regulation (EU) 2019/1020 on market surveillance and the Commission’s Blue Guide 2022.

    4. Service robots in Greek hotels: readiness checklist

    1. Define intended use. Document routes, payloads, lifts, operating areas and hours, guest groups and foreseeable misuse.
    2. Map the supply chain. Name the manufacturer, authorised representative if relevant, importer, distributor, installer, maintainer and hotel contracting entity.
    3. Fix the regulatory date. Record evidence for when each unit is placed on the market; do not rely solely on purchase-order date.
    4. Build an evidence pack. Obtain the declaration, identifiers, instructions, standards list, conformity route and contacts. Define a process for authority requests; the hotel need not receive the complete technical file.
    5. Review site hazards. Test routes, slopes, doors, lifts, fire routes, charging, network loss, emergency stop, recovery and vulnerable-user interactions.
    6. Control modifications. Require written safety review before payload, sensor, speed, enclosure, software, map, API or lift-integration changes.
    7. Plan operations. Assign trained owners for checks, incidents, cleaning, batteries, maintenance, updates and shutdown decisions.
    8. Address data. Identify what cameras, microphones, identifiers, telemetry and logs collect, their purposes, retention, access and processors.
    9. Set acceptance gates. Withhold operational acceptance until documents, safety tests, training, spare-parts terms, cybersecurity contacts and corrective-action routes are complete.
    10. Retain records. Preserve contracts, declarations, instructions, serial numbers, configuration baselines, training, incidents, updates and modification decisions.

    Privacy is a separate analysis. If robot sensors process personal data, the GDPR applies according to the actual purposes, roles and processing. The AI Act may be an adjacent regime only if the system and use fall within its scope; the label “AI-powered” does not by itself establish a specific classification. Neither regime replaces machinery safety analysis.

    5. Illustrative cost and decision example

    The arithmetic is €22,000 + €2,500 + €1,200 + €3,000 + €1,800 + €2,400 = €32,900. This is a cost boundary, not a benefit estimate. The hotel should separately measure successful missions, staff intervention minutes, downtime, guest disruption, consumables, connectivity, maintenance, battery replacement and contract-exit costs during a controlled trial.

    Suppose management sets a first-year cash ceiling of €30,000. On these assumptions, the option exceeds the ceiling by €2,900 before VAT, duty or contingency. The rational outcome is not to invent labour savings to close the gap. It is to renegotiate scope, compare an EU-distributed offer with clearly allocated importer duties, run a smaller paid trial, or stop. A decision model should show sensitivity: a delayed lift interface, mandatory site changes or a support renewal can change the answer without any change in robot price.

    Evidence gaps also carry costs. Missing economic-operator details, conformity route, declaration or change control can delay acceptance, create remediation cost or undermine safe operation. Give each gap an owner and deadline rather than an arbitrary ROI percentage.

    6. Risks, open questions and go/no-go gates

    • Classification: Is the delivered configuration machinery, related product, partly completed machinery or a combined assembly, and which other EU acts apply?
    • Conformity route: Does it fall in an Annex I category, which standards cover which hazards, and is notified-body involvement required for this route?
    • Placement timing: What evidence establishes the market-placement date for each unit around 20 January 2027?
    • Integration: Who is responsible for lift interfaces, automatic doors, charging equipment, networks and safety-related software changes?
    • Modification: Could the hotel, integrator, importer or distributor become the manufacturer under Article 17 or 18?
    • Residual risk: Are routes safe during crowds, spills, alarms, network loss and evacuation, and can staff recover the unit without creating a new hazard?
    • Data and cyber controls: What data leave the property, who can remotely access the robot, how are updates authenticated, and what happens when support ends?
    • Contract enforcement: Are document delivery, defect response, recalls, updates, spare parts, insurance and termination rights explicit?

    A go/no-go gate requires product identity, supply-chain roles, acceptable evidence, a site risk review, controlled changes, an operator and bounded cost. Seek qualified legal advice on roles and contracts, conformity expertise on classification and technical routes, and safety specialists for the hotel environment.

    7. Bottom line and FAQs

    Hotels do not need to wait until 2027 to prepare. Build one evidence pack per configuration now, name the economic operators, distinguish an importer from a buyer, and place every integration change under review. Then compare the complete first-year cash requirement with a measured operational trial. That sequence turns service robots in Greek hotels from a showroom proposition into an auditable procurement decision.

    Does every service robot need a notified body?

    No. Under Article 25, the route depends on Annex I classification and the applicable standards or common specifications. Some routes allow internal production control; others require third-party involvement. Confirm the exact configuration and verify any claimed body in NANDO.

    Is a hotel automatically the importer when it buys a non-EU robot?

    No. The factual supply route matters. A Greek hotel that directly places a third-country product on the EU market may be the importer, while a hotel buying from an EU importer or distributor may be an end user. Document the chain and obtain advice where the role is uncertain.

    Does CE marking complete the hotel’s due diligence?

    No. CE marking is important, but the hotel should also match the declaration, model and instructions to the delivered configuration, understand the conformity route, test the site and control later modifications.

    Can instructions be digital only?

    The Regulation permits digital instructions subject to Article 10 conditions for access, download, saving and continued availability. A free paper copy must be supplied on a purchase request within one month. Contract for durable access.

    Can a software or hardware change make the hotel a manufacturer?

    Potentially. Article 18 applies where a person carries out a substantial modification. Article 17 can also affect importers or distributors that rebrand or make compliance-affecting modifications. The technical effect, not the project label, is decisive.
